      • If applying for an extension, your partner has Indefinite Leave to Remain (ILR) as a PBS migrant or has obtained British citizenship after having ILR as a PBS migrant.

  3. Duration of Relationship (for Unmarried or Same-Sex Partners):

    • You have lived in a relationship similar to marriage or civil partnership for at least 2 years.

  4. Intentions:

    • Your relationship with the PBS migrant is genuine and ongoing, and you intend to live together throughout their stay in the UK.

    • You do not plan to stay in the UK beyond any period of leave granted to the PBS migrant.

  5. Financial Requirement:

    • You satisfy the maintenance funds requirement, unless the PBS migrant is a Tier 1 Investor migrant.

  6. Previous Visa Status (for Leave to Remain Applications):

    • You were not last granted entry clearance or leave as a visitor, short-term student, temporary admission, or temporary release.

  7. Criminal Record Certificate (for Tier 1 Investor or Tier 1 Entrepreneur Partners):

    • If over 18 and applying as a partner of a Tier 1 Investor or Tier 1 Entrepreneur, you have provided a criminal record certificate from relevant authorities in countries where you have resided for 12 months or more in the past 10 years.

For Children of PBS Migrant:

  1. Age and Dependency:

    • You are under the age of 18 at the date of application, unless applying for leave to remain and were last granted leave as a child of a PBS migrant.

  2. Parent’s Status:

    • You are the child of a person who holds leave as a PBS migrant, is being granted leave at the same time, or has Indefinite Leave to Remain (ILR) or British citizenship based on ILR under Tier 1, 2, or 5 rules.

  3. Independence:

    • You are not married, in a civil partnership, leading an independent life, or part of an independent family unit.

  4. Intentions:

    • You do not intend to stay in the UK beyond any period of leave granted to the PBS migrant.

    • Both parents are lawfully present in the UK or being granted entry clearance or leave to remain simultaneously, unless specific exceptions apply.

  5. Parental Responsibility or Care Arrangements:

    • Both parents are present, unless the PBS migrant is your sole surviving parent or has had sole responsibility for your upbringing, or there are compelling family considerations with suitable care arrangements made.

  6. Financial Requirement:

    • You meet the maintenance funds requirement, unless the PBS migrant is a Tier 1 Investor migrant.
